Agreement between User and Lets Go SUP Pty Limited (Lets Go SUP)

The Lets Go SUP Web Site is comprised of various Web pages operated by Lets Go SUP.

The Lets Go SUP Web Site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the Lets Go SUP Web Site constitutes your agreement to all such terms, conditions, and notices.

No Unlawful or Prohibited Use

As a condition of your use of the Lets Go SUP Web Site, you warrant to Lets Go SUP that you will not use the Lets Go SUP Web Site for any purpose that is unlawful or prohibited by these terms, conditions, and notices.   • Download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner.
  • Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
  • Restrict or inhibit any other user from using and enjoying the Communication Services.
  • Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service.
  • Harvest or otherwise collect information about others, including e-mail addresses, without their consent.
  • Violate any applicable laws or regulations.

Lets Go SUP has no obligation to monitor the Communication Services. However, Lets Go SUP reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. Lets Go SUP reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.

Lets Go SUP reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Lets Go SUP’s sole discretion.

Always use caution when giving out any personally identifying information about yourself or your children in any Communication Service. Lets Go SUP does not control or endorse the content, messages or information found in any Communication Service and, therefore, Lets Go SUP specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service. Managers and hosts are not authorised Lets Go SUP spokespersons, and their views do not necessarily reflect those of Lets Go SUP.

Materials uploaded to a Communication Service may be subject to posted limitations on usage, reproduction and/or dissemination. You are responsible for adhering to such limitations if you download the materials.

Lets Go SUP does not claim ownership of the materials you provide to Lets Go SUP (including feedback and suggestions) or post, upload, input or submit to any Lets Go SUP Web Site or its associated services (collectively “Submissions”). Termination/Access Restriction

Lets Go SUP reserves the right, in its sole discretion, to terminate your access to the Lets Go SUP Web Site and the related services or any portion thereof at any time, without notice.

General

To the maximum extent permitted by law, this agreement is governed by the laws of the State of New South Wales, Australia and you hereby consent to the exclusive jurisdiction and venue of courts in New South Wales, Australia in all disputes arising out of or relating to the use of the Lets Go SUP Web Site. Use of the Lets Go SUP Web Site is unauthorised in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree that no joint venture, partnership, employment, or agency relationship exists between you and Lets Go SUP as a result of this agreement or use of the Lets Go SUP Web Site. Lets Go SUP’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Lets Go SUP’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Lets Go SUP Web Site or information provided to or gathered by Lets Go SUP with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Lets Go Surfing with respect to the Lets Go SUP Web Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Lets Go SUP with respect to the Lets Go SUP Web Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be drawn up in English.

Notices and Procedure for making Claims of Copyright Infringement

If you believe that your work has been copied in a way that constitutes copyright infringement, please provide Lets Go SUP the written information specified below. Please note that this procedure is exclusively for notifying GAME Group Stores PLC that your copyrighted material has been infringed.

  • An electronic or physical signature of the person authorised to act on behalf of the owner of the copyright interest;
  • A description of the copyrighted work that you claim has been infringed upon;
  • A description of where the material that you claim is infringing is located on the site, including the auction ID number, if applicable;
  • Your address, telephone number, and e-mail address;

About this Policy

We understand that the privacy of your personal details, and the security of your transactions with us, is of paramount importance to you. Lets Go SUP has therefore adopted data protection policies with respect to your privacy and security. Lets Go SUP’s Privacy Policy sets out the rules we will abide by when dealing with personal information we collect from individuals in the course of our business. Collection of your Personal Information

Lets Go SUP collects different information about you at different times. There are 4 broad categories of information that we collect from you:

1. Information we require to supply our services.

  • When you first sign up or contract with Lets Go SUP for our services, or when you make an inquiry about our services, we request information such as your name, address, telephone number, domain name, email details of your primary and secondary contacts, credit card details (if you are paying online). We may also ask for your age and gender.
  • We may also monitor and/or record telephone conversations with you from time to time in order to train staff and to improve our service to you.

2. Non personally identifying information.

  • In addition to the information you specifically provide above, Lets Go SUP operates statistics gathering software on its web site to collect information about the number of visitors coming to the site. No identifying information is collected by this software. The software records the IP address of the visitor only. We use this information to improve our own technical structure and performance, and to determine which areas of our web site are most popular.
  • We also use ‘cookies’. Cookies are pieces of information that a web site can transfer to an individual’s computer in order to allow that web site to store information about user preferences. We use cookies which expire once the visitor leaves our web site. Cookies are used to collect session ID’s. It is possible to adjust your Internet browser to refuse cookies, but you may find that this reduces the functionality of this site.

3. Other demographic information.
If you respond voluntarily to our surveys or other interactive communications, we collect the responses and use the information to improve the quality and range of Lets Go SUP’s products and services.
4. Personal information stored on a web site hosted by Lets Go SUP.
Lets Go SUP will have personal information stored on our servers due to the fact that we host web sites of other organisations. Any information that is submitted to or collected by these organisations will be physically located on a Lets Go SUP server. This information, whether voluntarily provided or not, will not be used or released by Lets Go SUP in any manner, and it will be kept strictly confidential, unless we are required to release the information by law.

Use of your Personal Information

We will not reveal, disclose, sell, distribute, rent, licence, share or pass onto any third party (other than those who are contracted or supply services to Lets Go SUP including of spam filter operators) any personal information that you may have provided to us unless we have your express consent to do so, other than in the circumstances set out in the next paragraph. Security of your Personal Information

Accessing Your Personal Information

From time to time you may need to update your personal information. We keep this information in a secure environment which you can access through our website. In order to amend any of your personal information, you will be required to give your user name and password.
If you contact us via telephone, you will need to answer a few security questions before any personal information is revealed or amended.

Children’s Privacy

Lets Go SUP does not knowingly collect, use or market any information to children. We also urge you to familiarise yourself with your legal responsibilities with regard to children and the Internet, which can be found in our Acceptable Use Policy.

Complaints

If you have a complaint about any aspect of our Privacy procedures, please contact our Privacy Officer on info@staging.letsgosup.com.au. We will deal promptly with your complaint. If we cannot resolve the complaint to your satisfaction within a reasonable time, you or we may refer the complaint to the Privacy Commissioner.
